BEING A BY-LAW TO ENTER INTO AN AGREEMENT WITH
DENNIS ANTHONY FOLEY
WHEREAS the Municipal Act, 2001 c. 25 s.c. 2001 section 8 allows for the Powers of a Natural
Person and those powers may include the entering into an agreement.
NOW THEREFORE the Council of the Township of Augusta hereby enacts as follows that:
1. That the Township of Augusta enter into an agreement with Dennis Anthony Foley for
drainage of the North Campbell Road.
2. The CAO is hereby authorized to sign the agreement on behalf of the Corporation of the
Township of Augusta.
READ a first and second time this 16th day of August, 2010.

THIS TEMPORARY AGREEMENT made this 16th day of August, 2010
BETWEEN: The Corporation of the Township of Augusta,
hereinafter called the “Township”
OF THE FIRST PART
– and –
Dennis Anthony Foley
hereinafter called “Mr. Foley”
OF THE SECOND PART.
WHEREAS this is a temporary agreement between the Township and Mr. Foley,
owner of the lands with municipal address 2548 North Campbell Road, RR 1
Prescott Ontario;
AND WHEREAS this agreement will allow the Township to enter and re-construct a
drainage pipe across the property owned by Mr. Foley located at 2548 North
Campbell Road, RR 1 Prescott Ontario;
NOW THEREFORE THIS AGREEMENT WITNESSETH that in consideration of the
mutual covenants hereinafter contained the parties hereby covenant and agree as
follows:
1. The Township will survey a drainage easement, with site plan, prior to years
end, 2010. Mr. Foley will grant this drainage easement to the Township and
such documents will be registered on title at no cost to Mr. Foley.
IN WITNESS THEREOF the Corporation has caused its Corporate Seal to be affixed
as attested to by the hands of its proper Officers in that behalf and the Owner has
hereunto set his hand and seal.
