BEING A BY-LAW TO STOP UP, CLOSE AND SELL/TRANSFER PART OF A ROAD ALLOWANCE LOCATED IN PART OF LOT 15, CONCESSION 6, TOWNSHIP OF AUGUSTA, COUNTY OF GRENVILLE DESIGNATED AS PART 1 & 2 ON REFERENCE PLAN 15R-11604

THE CORPORATION OF THE TOWNSHIP OF AUGUSTA
BY-LAW NUMBER 3139-2015
A BY-LAW TO STOP UP, CLOSE, AND SELUTRANSFER PART OF A ROAD
ALLOWANCE LOCATED IN PART OF LOT 15, CONCESSION 6, TOWNSHIP OF
AUGUSTA, COUNTY OF GRENVILLE DESIGNATED AS PART 1 & 2 ON REFERENCE
PLAN 15R-11604

WHEREAS pursuant to the provisions of Section 34 of the Municipal Act, R.S.O. 2001,
c.25, as amended, the Council of every municipality may pass by-laws for stopping up any
highway or part thereof and selling same;

AND WHEREAS Council has deemed it expedient to stop up, close and sell part of the
road allowance in part of Lot 15, Concession 6, in the Township of Augusta, County of
Grenville, designated as Part 1 & 2 on reference plan 15R-11604.

AND WHEREAS notice of proposed by-law was published in the Brockville Recorder and
Times newspaper on December 27, 2014 and January 3, 2015.

AND WHEREAS Council has received no claims from any person that their land will be
prejudicially affected by the by-law.

NOW THEREFORE THE COUNCIL OF THE TOWNSHIP OF AUGUSTA enacts as
follows:

1. The portion of the road allowance in part of Lot 15, Concession 6, Township of
Augusta, County of Leeds & Grenville, designated as Part 1 & 2 on Reference Plan
15R-11604, is hereby stopped up, closed and shall be sold to the owner of the
property for roll number 070600002014800;

(a) All costs associated with this process, including survey, newspaper
publications and legal costs incurred by the Township, shall be borne by the
owner of the property for roll number 070600002014800;
(b) The deed transferring the said property to the owner of the property for roll
number 070600002014800 shall be prepared in a form satisfactory to the
Township’s solicitor.

2. The Mayor and the Clerk are authorized and directed to execute all necessary
documents in the name of the Township and to affix the seal of the Township
thereto.

3. That this By-law does not take effect until it has been registered.

Read a first and second time this 12 day of January 2015.

Read a third time and passed this 12 day of January 2015.
