THE CORPORATION OF THE TOWNSHIP OF AUGUSTA
By-law No 3280-2017
BEING A BY-LAW TO AMEND BY-LAW No. 2965
WHEREAS pursuant to the provisions of the Planning Act, Section 34, the
Council of a Municipality may enact by-laws to regulate the use of land,
buildings or structures for any purpose set out therein that is otherwise
prohibited;
AND WHEREAS By-law No. 2965 regulates the use of land and the use and
erection of buildings and structures within the Township of Augusta;
NOW THEREFORE the Council of the Corporation of the Township of Augusta
enacts as follows:
1. Schedule H1 of By-law 2965 is hereby amended by adding a Source
Water Intake Protection Zone Overlay in accordance with Schedule
A of this By-law.
2. The following new provision is inserted after section 6.41 and
before section 6.42:
6.42 Source Water Intake Protection Zone Overlay
6.42.1
The following uses are prohibited in accordance with the Clean
Water Act, on lands identified as Source Water Intake Protection
Area on Schedule A attached hereto and forming part of this
amendment:
a. Storm water pond effluent
b. The application of agricultural source material to land.
c. The storage of agricultural source material.
d. The management of agricultural source material.
e. The application of non-agricultural source material to land.
f. The handling and storage of non-agricultural source
material.
g. Livestock grazing and pasturing where the number of
animals on the land at any time is sufficient to generate
nutrients at an annual rate that is greater than 0.5
nutrient units/acre
h. Outdoor confinement areas and farm-animal yards
6.42.2 Risk Management Officer Exemption
If the Risk Management Officer or another person duly
qualified under the Clean Water Act determines that there
is no significant risk, then a use listed above may be
permitted without the need for an amendment to this Plan,
where such use would otherwise be permitted.
6.42.2 Residential Exemption
Section 6.42.1 does not apply where the only use of the
land is residential.
3. Sections following section 6.42 are hereby renumbered accordingly
4. All other applicable provisions of By-law 2965 shall continue to apply.
