BEING A BY-LAW TO APPOINT A DRAINAGE SUPERINTENDENT FOR THE TOWNSHIP OF AUGUSTA PURSUANT TO THE DRAINAGE ACT, RSO 1990

A BY-LAW TO APPOINT A DRAINAGE SUPERINTENDENT FOR THE
TOWNSHIP OF AUGUSTA PURSUANT TO THE DRAINAGE ACT, RSO 1990
WHEREAS Section 93 of The Drainage Act, RSO 1990 authorizes the council of a local
Township to appoint a drainage superintendent;
AND WHEREAS Section 227 of the Municipal Act 2001, provides for officers and
employees of the Township to implement and carry out council’s decisions, to establish
i practices and procedures, to provide advice to council on municipal
policies and programs and to carry out duties required by legislation;
AND WHEREAS Section 93 of the Drainage Act, R.S.O. 1990, provides where the
Council of a municipality can appoint a Drainage Superintendent who shall inspect the
drainage work, and shall initiate and supervise the maintenance and repair any drainage
work, assist in the construction and improvement of any drainage work and report to
council on these activities.
NOW THEREFORE THE COUNCIL OF THE TOWNSHIP OF AUGUSTA ENACTS AS
FOLLOWS:
1. McIntosh Perry Consulting Engineers is hereby appointed Drainage
Superintendent in accordance with the provisions of Section 93 of the Drainage
Act, R.S.O. 1990.
2. The Drainage Superintendent appointed hereunder shall receive such
remuneration as shall be mutually agreed upon by the company arid Council and
shall hold office until such time as the company withdraws its services or their
services are terminated by resolution of Council.
3. The Drainage Superintendent shall carry out the duties as imposed by The
Drainage Act, 1990 and shall submit such reports and carry out such other duties
as may be required from time to time by Council.
4. That this By-Law shall be in full force and effect upon the date of passing.
5. That By-Law 3515-2021 is hereby rescinded.
6. That any and all By-Laws or portions thereof conflicting with this By-Law are
hereby repealed.
